These Terms of Service ("Terms") govern your use of the website https://poolfenceinspectvic.com.au and any pool or spa barrier inspection services provided by Pool Fence Inspections (ABN 95 631 511 460) ("we", "us", "our"). By using this website or engaging our services, you agree to these Terms.
1. About our services
We provide pool and spa barrier inspections and Form 23 compliance certificates in accordance with AS 1926.1 (all editions: 1986, 1993 incl. parts 9A, 2007, 2012 and 2024) and the Victorian Building Regulations 2018. Our inspectors are BPC registered building practitioners.
2. Bookings, fees and payment
- Inspection fees are quoted at the time of booking and are inclusive of GST unless stated otherwise.
- Our standard inspection fee starts from $220, which includes the certificate, GST and call-out within our standard service area.
- Payment is due on or before the day of inspection unless otherwise agreed in writing.
- Re-inspections after rectification works are charged at our published re-inspection rate.
3. Cancellations and rescheduling
We ask for at least 24 hours' notice to cancel or reschedule an inspection. Cancellations made with less than 24 hours' notice, or where the inspector arrives and is unable to access the property, may incur a call-out fee.
4. Site access and safety
You are responsible for ensuring safe and reasonable access to the pool or spa barrier on the agreed inspection date and time. This includes unlocking gates, restraining pets, and disclosing any known hazards. If we cannot safely complete the inspection, we may reschedule and a call-out fee may apply.
5. Inspection outcomes
A pass result will be documented on a Form 23 compliance certificate, issued same-day where possible. A non-compliant outcome will be accompanied by a written defect report explaining what needs to be rectified. Lodging the certificate with the relevant local council (within 30 days, as required by Victorian law) is the property owner's responsibility unless we have specifically agreed in writing to do so on your behalf.
6. Limitation of liability
Our inspections relate to compliance with the applicable pool and spa barrier standards as at the date of inspection only. They are not a structural, engineering, building or pest inspection. Compliance can be affected by subsequent works, weather, plant growth, or removal/relocation of objects, and the property owner is responsible for maintaining compliance after the inspection date.
To the maximum extent permitted by law, our total liability for any claim arising out of or in connection with our services is limited to the fees paid by you for the inspection giving rise to the claim. Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot be excluded.
7. Intellectual property
All content on this website (including text, images, logos and reports) is owned by or licensed to Pool Fence Inspections and is protected by Australian and international copyright laws. You may not reproduce, distribute or commercially exploit this content without our prior written consent. Inspection reports and Form 23 certificates issued to you may be used for the purpose for which they were issued (e.g. lodgement with council, sale or leasing of the property).
8. Use of the website
You agree not to use this website in any way that is unlawful, infringes the rights of others, or interferes with its operation or security. We may modify, suspend or discontinue any part of the website at any time without notice.
9. Privacy
Information you provide to us is handled in accordance with our Privacy Policy.
10. Reviews and testimonials
Reviews displayed on this website are real reviews from our customers, sourced from our Google Business Profile and used with permission where required.
11. Governing law
These Terms are governed by the laws of Victoria, Australia. Any dispute arising under these Terms is subject to the non-exclusive jurisdiction of the courts of Victoria.
12. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on this page, with the "Last updated" date revised accordingly. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
